A fatal car accident is always a tragedy, but one that involves the death of an infant is often even more traumatic. This is especially true when the accident likely could have been easily prevented. The parents of a deceased infant in California may be considering a wrongful death lawsuit after their 6-month-old daughter died in a crash.
The incident reportedly happened on a day in early April. Though the day reportedly started with the family shopping for a baptismal outfit for their infant, it ended in tragedy. Reports indicate that the driver of a pickup failed to stop at a stop sign.
A 30-year-old woman driving a van attempted to avoid striking the truck; however, she is said to have swerved into the path of another vehicle, causing a head-on collision. Unfortunately, the infant was ejected from the vehicle. A witness describes discovering the body of the deceased baby. The driver of the van reportedly broke her leg in the crash and was transported to the hospital, but no other injuries were reported. Police do not believe that speed or alcohol played a role in the accident.
Instead of planning the infant’s baptism, the family is now left planning her funeral. While it will likely do little to reduce their grief, the infant’s surviving family members may choose to file a wrongful death lawsuit as many in California who have lost a loved one due to another person’s negligence have chosen to do. If successfully presented, the court could award the surviving family members damages that will help them cope with the financial consequences of their losses.
