Parents often go to great lengths to ensure that their children are safe. Despite their efforts, however, they cannot always protect them from all hazards, such as drivers who choose to get behind the wheel of a vehicle after consuming alcohol. Unfortunately, California police believe that DUI may have played a role in a recent crash that could ultimately result in a wrongful death lawsuit.

The incident happened around 10 p.m. on a day in late February. According to reports, the 35-year-old driver of a vehicle failed to stop at a stop sign as required. The vehicle, according to police, was traveling at around 100 mph at the time.

Unfortunately, the vehicle is believed to have struck another vehicle in the intersection The first vehicle reportedly overturned before coming to a stop in a dry irrigation ditch. The second vehicle was allegedly knocked against a tree. Two adults in the second vehicle suffered broken bones while an 8-year-old who has a backseat passenger died as a result of injuries suffered. Police attempted to perform a breath test on the driver of the first vehicle, but he was transported to the hospital and had blood drawn after he reportedly told law enforcement officials that “he was not able to” participate in the breath test.

Reports indicate that the driver of the second vehicle was previously convicted of DUI and was driving on a suspended license at the time. Police suspect that alcohol played a role in this accident. Unfortunately, a California family is now left mourning the unexpected, preventable death of their young child. A successfully presented wrongful death lawsuit could ensure that their financial responsibilities are met, potentially allowing them to focus on their recovery.
